Data protection declaration

Münch + Münch GmbH (henceforth „M+M“, more information can be found here) welcomes you to the website. Data protection and data security during the use of our website is very important to us. As such, we would like to inform you of what personal data we collect when you visit our site, as well as for which purposes we process said data.

As changes in legislation or in our company’s internal processes might require this data protection declaration to be adapted, we advise you to regularly re-read this data protection declaration. The data protection declaration can be retrieved, saved or printed out at any time.


1. Scope

This data protection declaration applies to the Internet presence of Münch + Münch GmbH which can be found under the https://www.muenchundmuench.com domain and various subdomains (henceforce named “our website”).


2. What is personal data?

Personal data is information that can be used to find out about your personal or factual circumstances (such as name, address, telephone number, date of birth or email address). Information which we cannot relate to your person (or only through considerable effort), such as by anonymising the information, is not considered personal data.


3. Which personal data do we collect/process and use?

A large part of our website can be used without having to submit personal data.
Log files are saved that contain the following information:

• the name of the retrieved file,
• the moment (date and time) of the retrieval,
• the amount of data transferred,
• a notification upon successful retrieval,
• your web browser, operating system and the requesting domain, as well as
• the IP address.

This data is evaluated exclusively for the improvement of our offer and does not allow any conclusions or assumptions about your person.
However, if you wish to make use of the services offered by us on our website, it is necessary for you to provide further data. This is the data that is necessary for the relevant processing, such as your email address when filling out the contact form.

We use your personal data that we collect to provide the products and services we offer, to answer your questions, and to operate and improve our websites and applications. We use your personal data exclusively to offer you a comprehensive service via our website or, if you use our contact form, to provide the requested service.

We will not forward any personal data provided to us online to third parties unless you have provided your consent beforehand. Your data is transferred to us with an encryption. The M+M companies are not classified as third parties in this context.

We reserve the right, however, to provide your personal data to external service partners in order to fulfil our contractual obligations in line with the BDSG and the GDPR.

Further use of your personal data does not take place. A transfer of your personal data to third parties or the use of your data for advertising purposes without your consent will not take place, except in the cases described below, unless we are legally obliged to disclose data (information to law enforcement authorities and courts; information to public bodies that are to receive data due to statutory provisions, such as social insurance agencies or tax authorities) or unless we involve third parties obligated to maintain professional confidentiality in order to meet our requirements.

In particular, personal data is used as follows:

a) Contact form

If you take advantage of our contact form to send us an enquiry, we will ask you for your first and last name, the name of your company and your email address. You may also provide an individual message in the message field.

It is your decision to provide us with this information. The information provided in the contact form is transferred with an encryption. Without this information, we cannot meet your request for contact.

If a business relationship is established on the basis of your contact request, we will save your personal data in our systems in accordance with the statutory provisions for the purpose of conducting this business activity.

b) Data upload

You have the possibility to send us messages and files via the "Data upload" menu item. This option as an alternative to sending emails is primarily intended for the transfer of large files. The transfer of files to our company-owned web server is encrypted. In this case, we ask you to enter your email address and the email address of the recipient in our company. It is not possible to enter a recipient email address that does not belong to Münch + Münch. After entering a correct captcha code (see 5. Google Services), you can enter a message, upload file(s) and send. If you wish, you can send yourself a copy of the generated message.
You are free to make use of this offer. The entry of email addresses is required for the technical functioning of this service. Without a correct sender email address, we cannot respond to your request.


4. User profiles / Use of cookies

Except in the above-mentioned situations, we do not create user profiles based on personal data. In connection with the retrieval of the information requested by you, data is only stored on our servers in anonymous form to allow for the provision of our various services or for evaluation purposes. Here, general information is logged, such as when which contents from our offer are called up or which pages are visited most frequently. You are free to make use of this offer. The entry of email addresses is required for the technical functioning of this service. Without a correct sender email address, we cannot respond to your request.

We use so-called „Cookies“ (small text files with configuration data). Cookies are small text files that are sent to your browser by our web server and which are stored on your computer for future retrieval.

The cookies help to determine the frequency of use and the number of users of our websites. Moreover, they continue to identify your computer during a visit to our Internet presence when changing from one of our web pages to another of our web pages and they are able to determine when your visit has ended. This tells us which areas of our websites and which other websites our users have visited. However, this usage data does not allow any conclusions to be drawn about the user. All of this anonymous usage data will not be merged with your personal data according to § 3 of this privacy policy and will be deleted immediately once the statistical evaluation has ended.

When you visit our website, cookies are saved on your computer permanently. The purpose of these is to optimise the usability and the simple and fast access to the website. 5. Google services

On our homepage, we use services provided by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Irland (“Google”.) When you click on the corresponding links, a direct connection will be established between your browser and the Google servers. Through this, Google receives the information that you have visited our site with your IP address.

One such service is reCaptcha. This fully automatic public text is to ensure that the details entered for a file upload was done by a person and not a machine.

A further service is Google Maps, which is embedded into our site. Google Maps uses so-called “Cookies” – text files – which are saved on your computer when you use the map function on our website. When you click on the Google Maps links when you are logged into your Google account, Google can tie your visit to our site to our user account. We would like to point out that, as the provider of this website, we do not have any knowledge of the content of the transmitted data or its use by Google.

Google Analytics uses so-called “Cookies” – text files – which are saved on your computer and which allow you to analyse the use of your website. The information regarding the use of this website generated by the Cookie are, in general, transferred to and saved on a Google server in the United States of America. It may be that Google passes this information on to third parties if required by law or if these third parties process this information on behalf of Google.

Should IP anonymisation be activated on this website, your IP address will be shortened by Google acting within territory of members states of the European Union or other signatory states as per the applicable European Economic Area agreement. Only in exceptions will the full IP address be sent to Google servers in the United States and then shortened there. We would like to point out that the Google Analytics code on this website has been extended with “gat._anonymizeIp();” to ensure the anonymous gathering of IP addresses (so-called IP masking).

On behalf of the owner of this website, Google will use the information to analyse your use of the website, to compile reports on activity on the site and to provide additional services to the website provider in regards to website activity and Internet usage. The IP address transmitted by your browser within the framework of Google Analytics is not combined with other data by Google.

You can prevent the saving of Cookies on your computer with the appropriate settings in your browser softer; we would like to point out that, should you do this, you may not be able to fully use all functions on this website. 6. Use of YouTube videos

We make use of embedded YouTube videos. YouTube is a service provided by YouTube LLC with headquarters in 901 Cherry Avenue, San Bruno, CA 94066, United States of America.

The IP address is transmitted when loading the website and when the videos are embedded. This IP address cannot be allocated unless you are logged in to YouTube or another Google service or are permanently logged in prior to accessing the site.
As soon as you start playing an embedded video by clicking on it, YouTube stores Cookies on your computer, but only which does not contain any personal data. 7. Security measures for the protection of our stored data

We are committed to protecting your privacy and treating your personal data confidentially. In order to prevent the loss or misuse of data stored on our servers, we take extensive technical and organisational security precautions, which are regularly reviewed and adapted to meet changes in technology.
However, we would like to point out that due to the Internet’s structure, it is possible that the rules of data protection and the above security measures may not be observed by other persons or institutions for whom we are not responsible. We have no technical influence on this. It is the responsibility of the user to protect the data made available by him against misuse by use of encryptions or any other means.


8. Hyperlinks to external websites

Our website contains so-called hyperlinks that lead to the websites of other providers. When these hyperlinks are used, you are forwarded directly from our site to those of the other providers. 10. Information on your personal data stored by us/data retention period/deletion

Your personal data will only be stored for as long as permitted by law. Stored personal data will be deleted if the user withdraws his or her consent or if holding of this data is no longer required for the purpose for which it was stored, in particular if the user account is deleted or if their storage is prohibited by other legal reasons.
At your request, we will be happy to inform you which personal data we have stored about you. If, despite our best efforts to obtain correct and up-to-date data, incorrect data is stored by us, we will correct it after written notification.

You have the option to check, alter or delete the personal data provided to us at any time by sending an email to Datenschutz@muenchundmuench.com.

Should you wish to have the stored data delete, this will take place immediately upon your request. If deletion is not possible due to legal reasons, the respective data will be blocked instead. Please note, however, that if your data is deleted, we will no longer be able to offer you the services described here.
